How to make sense of the small print, and get the right advice

Whatever you’re planning to buy at auction, it’s important to read and understand all the legal details.

The legal pack from a vendor’s solicitor can seem a little daunting – but with the right help, it’s more straightforward than you think.

What is the legal pack, exactly?

When someone’s preparing to sell a property at auction, their solicitor puts together a pack of all the legal papers any buyer needs to see before they go ahead. These can include special conditions of sale, title deeds, leases, office copy entries, searches, and replies to pre-contract enquiries.


What do I do with it?

You need to read and understand all the papers in the legal pack – or appoint a solicitor who has experience in the property market to read them for you. When you buy at auction, the transaction is subject to everything in the legal pack, so it’s really important.


How do I choose a solicitor?

It needs to be a solicitor we’re happy to work with – which means the firm should have at least two partners approved by the Solicitors Regulation Authority (SRA). You can find a list of these on the Law Society website.

You’ll also need to check the solicitor is happy to represent both you and us.  And, of course, they must have the expertise to deal with the transaction – and understand how things need to move quickly at auction. (Remember, in most cases, you have only 28 days to complete your purchase.)


Can I use a solicitor I’ve used before?

Yes, if it was for a similar property purchase – but they’ll need to have at least two partners approved by the SRA.
